FACTS. - Elsie, an elderly woman, contracted to sell land to two of her sons, Mark and Cloyd. Later, she deeded the land to Mark, Cloyd, and herself as joint tenants. Cloyd died. Elsie later deeded the same land to five others of her children. PROCEEDINGS. - At trial, the district court determined that Elsie did not comprehend what was happening, but appointed guardian ad litem. Elsie had no counsel. Court ruled that Elsie was not competent in signing the deeds, and specifically enforced the contract to Mark and Cloyd.
